Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Onyx Mobile Detailing, a mobile automotive detailing business operating in the State of Colorado ("Onyx," "Company," "we," "us," or "our"), governing your access to and use of onyxdetailing.com (the "Site") and our mobile detailing services (the "Services").

By accessing the Site, requesting a quote, or booking a Service, you affirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal authority to enter into this agreement, and you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Site or the Services.

2. Description of Services

Onyx provides mobile automotive detailing services performed at a location specified by the Customer. Base packages are tiered by vehicle size — Standard Vehicle, SUV/Larger Vehicle, and Premium/Luxury Vehicle — and include interior and exterior detailing. Customers may select optional add-on services, some of which are priced as a starting ("From") amount as described in Section 5.

We reserve the right to modify, discontinue, or update the scope, pricing, or availability of any Service at any time, with changes reflected on the Site.

3. Booking and Scheduling

Bookings are subject to availability. Submitting a booking request does not guarantee that a technician will be available at the requested time; we will notify you if we are unable to accommodate a request.

We reserve the right to decline, cancel, or reschedule a booking, at our sole discretion, if site conditions (including lack of safe parking, water access, or electrical access, where required) prevent the safe or effective performance of the Service, or for any other reasonable business reason.

4. Guest Bookings and Accounts

You may book a Service as a guest by providing the required contact, vehicle, and address information, or you may create an account for a streamlined experience and access to your booking history. You are responsible for maintaining the confidentiality of any credentials associated with your account and for all activity that occurs under it.

5. Pricing, Estimates, and Payment

Base package prices and add-on prices in effect at the time of booking are displayed on the Site. Prices are subject to change without notice for future bookings but will not change for a booking already confirmed, except as described below.

Certain add-on services are priced starting at a minimum amount, denoted "From," because the labor and materials required depend on factors that cannot be fully assessed until the technician inspects the vehicle in person. The final price for these add-ons, and for the booking as a whole, may vary based on the vehicle's size, overall condition, extent of staining or soiling, presence of pet hair, excessive dirt or mud, and any additional time reasonably required to complete the Service to a professional standard. Where practical, the technician will communicate any price adjustment to you before proceeding with the additional work.

Payment is due at or before the time of service using the payment method(s) made available through the Site's checkout process, which is operated by our third-party payment processor, Square. Onyx does not directly handle or store your full payment card information.

6. Cancellations, Rescheduling, and No-Shows

You may cancel or reschedule a booking by contacting us as far in advance as reasonably possible so that the reserved time slot can be made available to other customers. Repeated late cancellations or failure to be present or to provide access to the vehicle at the scheduled time and location ("no-show") may, at our discretion, result in a cancellation fee, a requirement of prepayment for future bookings, or refusal of future service.

7. Vehicle Condition, Customer Disclosures, and Pre-Existing Damage

You are responsible for disclosing any known mechanical issues, prior damage, aftermarket modifications, or delicate/non-standard surfaces (such as raw or unsealed paint, vinyl wraps, or specialty coatings) that may affect how the Service should be performed. You should remove cash, jewelry, electronics, firearms, and other valuables or personal items from the vehicle before the appointment; Onyx is not responsible for items left in the vehicle.

While our technicians exercise professional care with every vehicle, detailing services inherently involve contact with a vehicle's existing paint, trim, upholstery, and other surfaces. Onyx is not responsible for pre-existing damage, wear, mechanical defects, or the discovery of such conditions during the Service, nor for damage resulting from undisclosed defects, prior improper repairs, or non-standard aftermarket products applied to the vehicle before our Service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ONYX, ITS OWNERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SITE OR THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ONYX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONYX'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO A SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ONYX FOR THE SERVICE GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS IS INTENDED TO LIMIT LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

9. Disclaimer of Warranties

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, ONYX DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ONYX DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Onyx and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your breach of these Terms; (b) your violation of any applicable law; (c) inaccurate information you provided in connection with a booking; or (d) undisclosed vehicle conditions described in Section 7.

11. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Onyx or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent, except as necessary to use the Site for its intended booking purposes.

12. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose or in violation of these Terms; (b) submit false, fraudulent, or misleading information in connection with a booking; (c) interfere with or disrupt the operation of the Site or attempt to gain unauthorized access to our systems; or (d) use automated means to scrape, extract, or reproduce content from the Site without authorization.

13. Third-Party Payment Processor

Payment processing services are provided by our third-party payment processor, Square, and are subject to its own terms of service and privacy policy. By submitting payment through the Site, you agree to be bound by Square's terms in addition to these Terms.

14. Dispute Resolution and Governing Law

These Terms, and any dispute arising out of or relating to them or to the Services, are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles, and, to the extent applicable, federal law.

Before initiating a formal legal proceeding, you agree to first contact us at info@onyxdetailing.com to attempt to resolve the dispute informally. If a dispute cannot be resolved informally within a reasonable time, the parties agree that any legal action shall be brought exclusively in the state or federal courts located in Colorado, and each party consents to the personal jurisdiction of such courts.

15. Force Majeure

Onyx shall not be liable for any delay or failure to perform the Services resulting from causes beyond its reasonable control, including severe weather, natural disasters, acts of government, labor disputes, or other events of force majeure.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any order or booking confirmation provided to you, constitute the entire agreement between you and Onyx with respect to the Site and the Services, and supersede any prior or contemporaneous agreements, communications, or understandings, whether written or oral.

18. Changes to These Terms

We may amend these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Your continued use of the Site or the Services after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Site and the Services.
